Buying a home is perhaps the most important and risky investment that a family will make throughout their lives. So that the process of buying and selling your dream home is carried out correctly, it is essential to leave it in the hands of a qualified and experienced professional.
In Mario Redondo Solicitors we have been helping citizens, mostly British citizens, for more than 15 years so that the purchase of their homes in Spain is something simple that they don’t have to worry about and fulfilling all the legal requirements to avoid future unpleasant surprises.
Our advice covers the entire process of acquiring a home, from the analysis of the necessary legal documentation related to the home and the type of land on which it is located, through the obtaining of the necessary NIE Certificate, opening of a bank account and registration of the property in the name of the buyer in the Property Registry.
Our team will emphasize the analysis of the documentation and legality of the home. The type of land on which the house is located and the possible future repercussions will be explained to the client.
Our professionals can act for you using a power of attorney. In this way your presence in Spain will not be necessary while the home purchase is carried out. Even if you are already in Spain, our lawyers can carry out the entire process for you without having to worry about anything.
We have tax experts who will advise you in relation to the type of taxes that you will have to face, according to the type of property you buy, and all this in advance to avoid future surprises.
In general, the Patrimonial Transfer Tax amounts to 8% of the value declared in Public Deed, but sometimes the Tax Agency considers said value to be less than the legal minimum legal value established, being able to claim significant amounts of money from the buyer. We will ensure that you know in advance what that minimum value is and thus avoid unpleasant fines.
In Spain the public deeds of sale must be signed before a Notary Public. In this office we are experts in notarial documents and work daily in contact with the notary, preparing and reviewing all the necessary documentation to buy the house legally and without surprises.
Registration in the Land Registry is the last legal step to acquire a home in Spain.
We take care of presenting all the necessary documentation in the Property Registry to transmit the property on behalf of the buyers.
Within the legal conveyance service, our team will contract for you supplies such as water, electricity, garbage collection, and managing the payment of those services by direct debit.
You will have nothing to worry about, just enjoy our climate, our lifestyle and the home of your dreams.
In the sale of a property by a non-tax resident, the buyer is obliged to withhold 3% of the sale price and pay it within 30 days in the tax agency’s account as advance payment or deposit for the Capital Gains Taxes that may be incurred by the non-resident tax seller. This withholding occurs in any case, even in the case where the seller is not getting any benefit from the sale or even in cases where it is generating a loss. It is in these cases in what the said 3% paid to the Treasury can be claimed back within certain time limits. Our team of lawyers will be in charge of requesting said return and this included in the sale process of your property, without charging extra fees for it, being able to even manage the return of the amount withheld to an account in the United Kingdom.
Our team of lawyers specializing in real estate law will advise and also represent you in the sale of your property in Spain. We will verify that you gather all the necessary documentation to put the house for sale through the real estate agency, and if not, we will guide you and help you obtain all that documentation: necessary certificates, occupancy license, energy performance certificate, etc. Even our legal team collaborates closely with several architects, being able to manage the legalization of their constructions that have never been included in their Public Deed. A part of great importance in the sale of a home is the tax part or taxes. We will advise you about the tax implications in the sale of your home depending on your tax situation in Spain, since the procedure of declaration and payment of Capital Gains taxes varies according to that condition. If you sell your property as a non-tax resident, you must take into account the 3% RETENTION that the buyer will be obliged to make and pay to the Treasury.

your questions in a timely manner.
